ST THFIELD Council will not pay the legal expenses of former Strath eld councillor Danny Lim (pictured) arising from legal proceedings involving Robert Bourke, the council's director of operations. Bourke applied for an apprehended personal violence order (AVO) against Lim in December 2009 alleging "harassment and intimidation". ese legal proceedings were resolved in a private se lement on March 25, 2010, but Lim subsequently sent a claim to council for $29,429.70 to cover his legal costs. Although the legal dispute between the two men has now been se led, both men made Code of Conduct allegations against each other. e Conduct Review Commi ee dismissed Lim's complaint as lacking "prima facie evidence", but upheld the complaint made by Bourke. e commi ee found that Lim had engaged in conduct "contrary to the Code of Conduct and [that] the conduct was inappropriate and constituted misbehaviour." e council concluded that Lim's claim for reimbursement did not meet any of the provisions of the Councillors Expenses and Facilities Policy. His claim was dismissed. By Natalie O'Brien Former deputy mayor Keith Kwon has this week lost his pivotal positions as chairman of the Planning and Tra c Commi ees. In a new line-up, Cr Paul Barron has been appointed chairman of the Planning Commi ee, with Mayor Tony Maroun as deputy, and chairman of the Social Commi ee. Cr Maroun is also chairman of the Tra c Commi ee with Cr Barron as his deputy. Councillor Bill Carney has been appointed chairman of the Economic Commi ee, while deputy Mayor Hope Bre -Bowen has been appointed as chairwoman of the Environmental Commi ee. At the meeting, Cr Kwon put forward a motion asking state MPs to amend laws so that only people who live and work in Strath eld can be elected to the council -- a move which would render current Mayor Tony Maroun ineligible for his position. Cr Carney proposed the motion be amended to ask for a report into the ma er before the council makes a nal decision. He asked for a report to be prepared. Cr Paul Barron said he, too, would like to see a report on the issue. "I don't want to look like a fool by sending o a le er when there might be a good reason why this was done," Cr Carney told the meeting. Councillors were deadlocked three-all over the motion until Cr Maroun used his casting vote to support Cr Carney's amendment, telling the meeting that Cr Kwon's motion was "a very divisive issue just before a local government election". Cr Kwon wanted members of State Parliament to amend the Local Government Act to require all candidates for local government elections to reside in the area, be a ratepayer or a business owner. He argued that unless candidates lived or worked locally they do not have the in-depth knowledge of the needs of local ratepayers. At present, candidates who do not live or work in the area can be endorsed by a business owner from the area -- as is Cr Maroun. But Cr Kwon denied he was a acking Cr Maroun. " is is not having a personal dig at Cr Maroun," he said. "What has happened has happened. is is for the future."
